However, there are laws regarding the amount of cannabis that an individual can possess. If you’re Santa, or live in these states, it is important to remain within the legally mandated limits to give cannabis as a gift. Here is an overview of the laws in the eight states where cannabis is legal for recreational use:
In Colorado, adults over the age of 21 are allowed to possess an ounce of cannabis. It is legal to give an adult over the age of 21 up to an ounce of marijuana. As with alcohol, it is illegal to give cannabis to anyone under the age of 21.
Unfortunately, it won't be possible to legally give cannabis as a Christmas gift in Nevada this year. The new legalization law does not go into effect until January 1 of 2017. When cannabis is legalized in Nevada, the personal possession/gifting limit will be one ounce of cannabis. In addition, it will be possible to legally give or possess as much as one eighth of an ounce of cannabis concentrates.
The limit for personal possession or gifting in Alaska is one ounce. The legalization has been in effect for quite a while. This means there are plenty of dispensaries to choose from in Alaskan cities.
The laws in Oregon are quite similar to those in Alaska. This makes it possible to legally give an ounce of cannabis this Christmas.
In Massachusetts, a law recently went into effect that makes it possible to possess cannabis legally. It went into effect on December 16, 2016. The possession limit is one ounce, and it is possible to possess or gift as much as 5g of marijuana concentrate or hash.
Unfortunately, marijuana legalization in Maine has not gone into effect yet. In the state, the governor has to declare the election results to be valid. This could take as long as until January 7th. However, it will be possible to legally give cannabis as a gift in Maine by next Christmas! The possession or gifting limit will actually be higher than the other states at 2.5 ounces.
Currently, it is possible to legally possess as much as one ounce of marijuana in California. It is also possible to give as much as 8g of marijuana concentrates. These amounts can be given as a gift to individuals over the age of 21.
It is legal to possess cannabis in the capitol. The legal possession limit is two ounces, but it is legally possible to give no more than one ounce as a gift. It is also important to note that marijuana can only be used on private property.
